avoiding a contract dealing with heirlooms?

. Denny Hitme has been attorney for Ben Dover for many years. Ben is now old and senile. Denny induced Ben to sell some valuable assets to him, which Denny paid for. Eileen Dover, Ben’s daughter, thought that Ben considered those items to be family heirlooms that her father never intended to sell to anyone. Eileen calls you and asks whether there is any way of getting her father out of the contract and getting her father’s assets back. Suggest the BEST grounds for avoiding this contract and explain the reasons for your answer.

  1. Prove the senility provision. If Ben is not capable of making decisions on his own, he should have someone with a Power of Attorney making these decisions.
